Terms of use of the service
Mestal AS, Innherredsveien 92A, company no. 933 649 121 VAT, operates a rental service.
1 General
These terms and conditions apply to the rental and sale of goods and services from www.mestal.no to businesses and consumers. The terms and conditions will, together with your order, constitute a comprehensive agreement for the purchase.
2 Definition of parties
The lessor or seller is: Mestal AS and is hereinafter referred to as we, us, the lessor or Mestal as.
The lessee is: The person stated as the lessee or buyer in the order, and is hereinafter referred to as the lessee, the customer, you, you, yours or yours.
Rental objects mean everything that is rented out on mestal.no.
Delivery method/service points generally mean delivery.
3 Payment, deposit and prices
ZERO DEPOSIT, ZERO OWNERSHIP IN SPAIN.
Payment is made via Visa or Mastercard online via our payment intermediary Formider, which meets the strictest security requirements. The tenant pays when ordering and the rental agreement is then considered concluded.
Mestal as follows standard rental practice and also reserves a deposit amount as stated on the order receipt when ordering. The reservation insures the company if the customer returns the object late, damages the object or does not deliver at all. The size of the deposit varies with the selected object being rented, and is stated in your order confirmation. Mestal as has the right to use the deposit to cover rent as well as other costs mentioned above and/or any recourse claims, cf. point 5 below.
This includes fines and other public impositions of taxes or other expenses.
All prices include VAT, unless otherwise specified. The total cost of the purchase will be disclosed before ordering and include all expenses associated with rental or purchase. If there have been errors with the prices of a significant size from the Company Name's side on the website, Company Name may unilaterally change, delete or reject orders even after the customer has received order confirmation or similar. However, such errors must be corrected and the customer informed within a reasonable time after the error is discovered.
Fee of NOK 250 per bot to handle the payment, plus the amount per bot.
4 Condition of the rental object
Mestal as undertakes to deliver rental objects of high quality in a ready-to-use condition. Mestal as has its own routines that check and maintain the rental objects before and after rental.
During the rental period, you are responsible for all damage or loss to the object. Exemption from liability may occur if the damage or loss is due to technical errors or defects. The renter is therefore obliged to check the rental object before use and contact Mestal as if the rental object is not in the expected condition.
Cars rented in the economy group are the cheapest cars we have. Also the oldest, and you get what you pay for.
In the event of a breakdown, you will of course be refunded the remaining rental time, but......... you are not guaranteed a replacement car in classes above if there is an empty one in the economy class.
5 Damage
ALL DAMAGES IN SPAIN ARE COVERED BY INSURANCE, ZERO DEDUCTIBLE, ZERO DEPOSIT - EXCEPT FOR GROSS NEGLIGENCE.
IN NORWAY, APPLIES :
All damages, technical faults or accidents that may occur during the rental period must be reported to Mestal as immediately at support@mestal.no. We will then do our best to help the renter. Damages are reported to support@mestal.no immediately. This also applies to theft.
If the damages occur due to incorrect use, intent or negligence, Mestal as will be able to use the previously reserved deposit and, if necessary, deduct additional outstanding amounts to cover the costs associated with repair, service or replacement of the object. This also applies if the equipment is returned in poor condition or is delivered dirty beyond normal.
We always strive to provide the best advice and tips for using the rental object, but are not responsible for performance or for direct or indirect damage or loss caused by the use of the rental object, delays or faults in the rental object.
Theft as a result of the car being stolen with the key is considered careless and is not covered by insurance.
6 Use of the rental object
Use of rental objects is at your own risk. The person using the equipment must be over 18 years of age.
The renter is responsible for ensuring that the equipment and accessories are used in such a way that it is not damaged or unreasonably soiled. Correct and safe use of the equipment is the renter's responsibility. The lessor facilitates the correct use of the equipment by making available user manuals, instructions and safety procedures together with the tool and/or on the lessor's website. It is the customer's responsibility to familiarize themselves with the lessor's use and safety routines before using the equipment.
The object is ONLY allowed to be used in the country it is rented/collected. Any other use beyond this is not allowed.
Violation of this will result in a one-time fee of 5000 NOK + cost of bringing the object home.
7 Accessories
Accessories must generally be purchased or rented separately when ordering.
8 Leiertagers rettigheter og plikter
The renter must be 18 years of age and is obliged to provide correct customer details when creating a user account in order to order and rent on www.mestal.no. Mestal as sends messages to the specified email, address and telephone number and such messages are considered received and valid when sent by us.
The user account is personal and if you suspect that others have access to your account, you are obliged to notify Mestal as immediately. Mestal as has the right to freely reject, terminate or suspend the user account without prior notice or liability, including if the terms are considered to be violated.
Furthermore, these rental terms must be accepted before ordering on the website.
The renter must return the rental object before the agreed date and time expires and in the agreed delivery method. The renter is expected to stay updated about the service point's normal opening hours.
The renter or cardholder authorizes Mestal as to make credit card instructions for, among other things, rental objects that are not returned, are dirty beyond normal or in the event of damage to the rental object. The authorization granted thereby also applies to the authorization to charge the payment card for additional rent/claims for compensation if the rental object is returned after the expiration of the agreed rental period or is returned with errors or defects.
Delay in returning the tool beyond 1 - one - hour in relation to the agreed rental period, entitles the lessor to one day's additional rent and a supplement, currently NOK 300, - which covers additional expenses Mestal as has in the event of late return. If the rental object is not returned after one day, Company Name is entitled to be reimbursed the agreed daily price as long as the object is actually in use and has not been returned by the lessee.
9 Change of order
To change an order, Mestal as must be contacted. The changes will not be valid until they have been confirmed in writing by us. This is to ensure that the rental objects are actually available. Unless otherwise agreed and confirmed, the rental object must be returned at the agreed time. Extension of the rental period can be made before the start of the rental period and/or during the rental period by changing the rental start or end.
Changes and cancellations of rental objects that result in the availability of the rental objects for other users changing may be associated with a change fee to cover the costs of rebooking. The change fee is currently 300 kroner. All costs will be informed to the renter before placing an order or changing an order.
10 Delivery and return
Delivery and return take place in the manner, at the place and at the time stated on the order confirmation. You can also find it under your page. We are responsible for the products until they are taken over by you, that is, when you have received the products in your possession. In order to receive the rental object, you must have your booking reference. The name you state on the reservation must match the name on the ID card upon collection.
If the delivery of the rental items is delayed, we will provide you with information as soon as we have knowledge of it, together with information about whether and when delivery can take place, or whether the product(s) is/are sold out or the rental item(s) is/are not available.
You are responsible for the product until it is returned to us or our service points.
We check the condition and function of the rental items and that all parts are present when they arrive at our warehouse.
If the rental product is damaged or unavailable between booking and collection, the lessor is obliged to deliver the same car class or a larger car.
Upon complete delivery in contractual condition, the reservation for the deposit on the payment card will be deleted.
The rental item must be returned with the same amount of fuel as delivered.
If less fuel than delivered, the lessee will be charged 25 euros per quarter tank begun.
In addition, a fixed fee of 25 euros regardless of the quantity.
11 Membership
Membership entitles you to price reductions and other membership benefits. Both private individuals and businesses can be members, but it is the person who is registered who is legally responsible and party to the agreement.
Membership is automatically renewed until terminated by the tenant. It is terminated on the account page by stopping the subscription. The membership will then expire at the end of the current period and then be terminated.

To exercise the right of cancellation, the product must be delivered to us in approximately the same quantity and condition as you received it. If you try, use or examine the product (open packaging etc.) in a way that goes beyond what is necessary to determine the nature, properties and function of the product and this results in the product being reduced in value, we may deduct an amount corresponding to the reduction in value from the purchase price to be refunded. For example, if you try a dust mask, saw with a saw blade, or drill a hole with a drill, the right of cancellation does not apply.
The product must be returned to us in the original packaging and within a reasonable time, together with the right of cancellation form. The easiest way is to return the item in the same box as when you return the rental object. Then there are no costs for you. Fill out the cancellation form and put it in the box. If you choose to send it back by mail or other methods, it is your responsibility until the item has reached us. You must provide your own, suitable packaging and contact us before sending.
13 Intellectual property rights
The content and service are protected by the Copyright Act. Image material stored on the site has been obtained with permission from the copyright holders. Videos on YouTube are links to third-party services outside of Mestal as's control.
14 Privacy
Mestal as processes your personal information in a secure data register in order to fulfill its obligations and safeguard its rights according to the rental agreement. The personal information that is processed is name, address, telephone number, e-mail address and order history. This history will remain stored for accounting and other obligations. All stored information is available on ""My account"". The tenant has the right to have their personal information removed from the landlord's systems, which is done by personally contacting Mestal as.
Your payment card will be stored as long as you have an active order. The payment card is stored by our payment intermediary DIBS. They store the information in a safe and secure manner. Storing payment cards makes it even easier when you shop. You can delete payment cards on your site. Mestal as does not store any credit card details itself.
Mestal as uses cookies, like most other online stores. Cookies store data in your browser so that the website can recognize you from page to page and visit to visit. We can then recognize who you are so that you can, among other things, get the right prices and easier login. We also collect usage information to improve the quality of the service.

15 Governing law
These terms and conditions are governed by and shall be interpreted in accordance with Norwegian law. The agreed venue is Oslo District Court.
16 Changes
Mestal as reserves the right to change or replace these terms and conditions at any time. The current terms and conditions are always available at www.mestal.no. If Mestal as considers that the changes to the terms and conditions are material in relation to the tenant's rights or obligations, the changes will be made available on mestal.no 30 days before they come into force.
By using the service after the changes to the terms and conditions have been made available on mestal.no, you agree to be bound by the updated terms and conditions. If you do not wish to accept the new terms and conditions, you may not use Mestal as.
Short version Rental car
Rentee / driver:
Rentee must be 18 years of age and hold a valid class B driver's license.
Ordering:
The entire rental amount is due upon booking.
Pick-up/drop-off:
Pick-up between 3:00 PM and 6:00 PM. Drop-off between 11:00 AM and 12:00 PM.
Other times by arrangement.
In the event of late return, a new day's rental will be charged unless otherwise agreed. The car must be thoroughly cleaned inside and out. The car must be returned with a full tank of fuel.
If there is a "no show", the rental is considered completed.
Fines:
Parking fines, illegal toll passes, illegal use of tax-free diesel, etc. that the renter has not settled, will be charged to the renter afterwards. In addition, there is an administration fee of NOK 250 per offense.
Damage:
Norway deductible - Spain no deductible.
Damage to the vehicle caused by the renter during the rental period is charged according to the cost of repair. Dents and minor damage that reduce the value of the car is charged according to the estimate. If insurance must be used to cover the damage, the deductible is charged up to NOK 4,000 per damage. The deposit is used to partially pay the deductible.
When renting a car, all damage is covered by insurance. Except for gross negligence, except for lost keys, which is NOK 2,000, and except for the wrong fuel, which is the workshop's rate in the form of emptying the tank and engine.
Theft of a car, with the car's key, is considered careless, and is not covered by the car's insurance.
Pets:
We do not allow pets in our cars, unless otherwise agreed.
Renter's responsibility:
The car undergoes an inspection before rental.
During the rental period, the renter is responsible for the car by, among other things, checking/refilling the necessary oil, water in the radiator, etc.
We expect careful treatment of the car so that the trip is successful.
The cars are non-smoking.
If unforeseen problems arise, the renter is obliged to contact Mestal AS to try to solve the problem. Compensation for any reduced use of the car is not given for faults and defects that are only reported upon return.
Accident:
The lessor does not provide compensation for lost vacation/earnings if damage or engine failure etc. occurs to the ordered car. The deposit and rent paid will then be returned in full. However, we do our best to find another car.
If an error/damage occurs along the way, the renter will be refunded the rent for the days the car is for repair, but not for a delay in repair that is less than 12 hours. If the renter chooses not to spend time on the repair, no refund will be given.
If the error is demonstrably caused by the renter, no refund will be given.
Most insurance companies offer free return travel for long-term repairs.
We always recommend having your own travel insurance in addition to ours. Preferably NAF insurance, which is excellent.
Toll tag:
Our cars have an autopass tag. The tags are used in all toll rings associated with autopass, as well as ferries. A fee for passes will be invoiced.
Can take 1 month.
Insurance:
The rental price for cars includes full insurance, without deductible.
Insurance does not apply to gross negligence.
It is recommended that the renter takes out their own travel insurance. In the event of incorrect refueling, use of red diesel or other damage for which the renter is responsible, and which is not covered by the comprehensive insurance, all expenses must be covered by the renter.
In the event of loss of key, 2000 NOK must be paid.
The cars are insured.
NB! In the event of damage, a damage report must be filled out.
Rental price:
The rental is paid at booking. The rental price is based on free km.
Deposit:
The deposit is 4000,- and will be reserved on the account. (NORWAY ONLY)
The car must be delivered clean inside and out (meaning free of garbage). In the event of failure to clean, 2000 NOK will be charged.
Cancellation:
When canceling the car, there is no refund.

OPERATION/USE
Every driver confirms that he/she is fit to drive a vehicle in Spain, or Norway.
Every driver confirms that he/she is fit to check simple things on the car such as lights, oil level, air pressure, wipers, and change7top up if necessary.
(it would be stupid if we were to spend 5-6 hours on something you fix in 10 minutes)
Costs will of course be refunded against receipt.
The renter undertakes to hold the owner harmless, indemnify and release the owner for damages, personal injuries, loss of property or death caused while the renter is driving this vehicle.
Smoking is not allowed in the car. We have allergy sufferers who rent a car.
If we find ash or traces of smoking in the car, you will be charged 2000,- for cleaning the car
Since these are used cars, things can happen. The lessor shall in the event of an accident attempt to deliver a car in the same car class.
If no car is available as a replacement car, the lessor may offer the entire rental amount as a discount on the next rental.
Or if the lessee wishes, return the car and get the remaining rent refunded.
If the car breaks down or is not in a proper condition as a result of incidents that occurred between booking and collection, the lessor is only liable for an amount up to and including the rental amount.
AND shall refund the paid rent without delay, in the same way that the rent was paid.
The lessor is liable for an amount up to and including the rental amount.
