Terms of use of the service
Mestal AS, Innherredsveien 92A, org no 933 649 121 VAT, operates a rental service.
1 General
These terms apply to the rental and sale of goods and services from www.mestal.no to businesses and consumers. The terms and conditions, together with your order, will constitute an overall agreement for the purchase.
2 Definition of parties
The lessor or seller is: Mestal AS and is hereinafter referred to as we, us, lessor or Mestal as.
Tenant is: The person who is stated as the tenant or buyer in the order, and is hereinafter referred to as the tenant, the customer, you, you, your or your.
By rental objects is meant everything that is rented out on mestal.no.
By delivery form/service points is generally meant delivery.
3 Payment, deposit and prices
Payment is made via Visa or Mastercard online via our payment intermediary Formidler, which meets the strictest security requirements. The tenant pays when ordering and then the rental agreement is considered to have been entered into.
Mestal as follows normal rental practices and also reserves a deposit amount as stated on the order receipt when ordering. The reservation ensures the company if the customer returns the object late, damages the object or does not deliver at all. The size of the deposit varies with the selected object that is rented, and is shown in your order confirmation. Mestal as has the right to use the deposit to cover rent and other costs mentioned above and/or possibly recourse claim, cf. point 5 below.
This includes fines and other public impositions of taxes or other expenses.
All prices include VAT, unless otherwise specified. The total cost of the purchase will appear before ordering and will include all expenses associated with rental or purchase. If there has been a mistake with the prices of a significant size from Company Name's side on the website, Company Name can unilaterally change, delete or reject orders even after the customer has received order confirmation or the like. However, such errors must be corrected and the customer informed within a reasonable time after the error has been discovered.
Fee of NOK 250 per fine to handle the payment, plus the sum per fine.
4 Condition of the rental object
Mestal as undertakes to deliver high-quality rental properties in ready-to-operate condition. Mestal as has its own routines that check and maintain the rental properties before and after letting.
During the rental period, you are responsible for all damage or loss to the object. Exemption from liability can occur if the damage or loss is due to technical errors or deficiencies. The tenant is therefore obliged to check the rental object before use and to contact Mestal as if the rental object is not in the expected condition.
Cars rented in the economy class are the cheapest cars we have. Also the oldest, and you get what you pay for.
If there is a breakdown, you will of course get the remaining rental time refunded, but......... you are not guaranteed a replacement car in classes above if there is an empty seat in the economy class.
5 Injuries
All damages, technical errors or accidents that may occur during the rental period must be reported to Mestal as immediately at support@mestal.no. We will then do our best to help the tenant. Damages must be reported to support@mestal.no immediately. This also applies to theft.
If the damage occurs as a result of incorrect use, intentionality or negligence, Mestal as will be able to use the previously reserved deposit and, if necessary, deduct additional outstanding amounts to cover the costs associated with repair, service or replacement of the object. This also applies if the equipment is delivered back in its original condition or is delivered dirty beyond normal.
We always strive to give the best advice and tips for the use of the rental object, but are not responsible for execution or for direct or indirect damages or losses due to the use of the rental object, delays or faults on the rental object.
6 Use of the rental object
Use of rental properties is at your own risk. Anyone using the equipment must be over 18 years of age.
The tenant is responsible for equipment and accessories being used in such a way that they are not damaged or unreasonably soiled. Correct and safe use of the equipment is the Lessee's responsibility. The Lessor facilitates the correct use of the equipment by making user manuals, instructions and safety procedures available together with the tool and/or on the Lessor's website. It is the customer's responsibility to familiarize themselves with the Lessor's use and safety routines before using the equipment.
The object is ONLY allowed to be used in the country where it is rented/picked up. Any other use beyond this is not permitted.
Failure to do so will result in a one-off fee of NOK 5,000 + the cost of bringing the object home.
7 Accessories
As a general rule, accessories must be purchased or rented separately when ordering.
8 Tenant's rights and obligations
The tenant must be 18 years of age and must provide correct customer details when creating a user account in order to order and rent at www.mestal.no. Mestal as sends messages to the specified e-mail, address and telephone and such messages are considered received and valid when sent by us.
The user account is personal and if you suspect that others have access to your account, you must notify Mestal as immediately. Mestal as has the right to freely reject, terminate or suspend a user account without warning or liability, including if the terms are deemed to have been breached.
Furthermore, these rental terms must be accepted before ordering on the website.
The lessee must return the rental object before the agreed date and time expires and in the agreed form of delivery. The tenant is expected to keep up to date on the service point's normal opening hours.
The lessee or cardholder authorizes Mestal as to make credit card instructions for, among other things, rental objects that are not returned, are dirty beyond normal or in the event of damage to the rental object. The authorization thus granted also applies to the authorization to charge the payment card for additional rent/claims for compensation if the rental object is returned after the end of the agreed rental period or is returned with errors or defects.
Delay in returning the tool by more than 1 - one - hour in relation to the agreed rental period entitles the lessor to one day's extra rent as well as a supplement, currently NOK 300, which covers additional expenses incurred by Mestal as for late delivery . If the rental object is not returned after one day, Bedriftsnavn is entitled to be reimbursed the agreed daily price as long as the object is actually disposed of and not returned by the lessee.
9 Change of order
To change an order, Mestal as must be contacted. The changes will not be valid until they have been confirmed in writing by us. This is to ensure that the rental properties are actually available. Unless otherwise agreed and confirmed, the rental object must be returned at the agreed time. Extension of the rental period can take place before the start of the rental period and/or during the rental period by changing the rental start or rental end.
Changes and cancellations of rental objects that cause the availability of the rental objects for other users to change may be associated with a change fee to cover the costs of rebooking. The change fee is currently NOK 300. All costs will be disclosed to the tenant before placing an order or changing the order.
10 Delivery and return
Delivery and return takes place in the manner, at the place and at the time indicated on the order confirmation. You can also find it under your page. We are responsible for the products until they are taken over by you, i.e. when you have received the products in your possession. In order to have the rental object handed over, you must have your booking reference. The name you enter on the reservation must match the name on the ID card upon collection.
If the delivery of the rental objects is delayed, we will give you information as soon as we are aware of it, together with information about and possibly when delivery can take place, or if the product(s) are sold out or the rental object(s) are not available.
You are responsible for the product until it is returned to us or our service points.
We check the condition and function of the rental objects and that all parts are present when they arrive at our warehouse. In the case of complete delivery in contractual condition, the reservation for the deposit on the payment card is deleted.
11 Membership
Membership entitles you to reduced prices and other member benefits. Both private individuals and businesses can be members, but it is the person who is registered who is legally responsible and party to the agreement.
Membership is automatically renewed until it is terminated by the tenant. It ends on the account page by stopping the subscription. The membership will then expire the current period and then end.
12 Right of withdrawal on purchase
The Right of Cancellation Act gives you the right to cancel your purchases. The right of withdrawal applies to goods that have been purchased and not to rented objects. The right of withdrawal requires that you notify us of this no later than 14 days after you receive the delivery (See the right of withdrawal https://lovdata.no/dokument/NL/lov/2014-06-20-27 ).
To exercise the right of withdrawal, the product must be delivered to us in approximately the same quantity and condition as you received it. If you try, use or examine the item (open packaging etc) in a way that goes beyond what is necessary to determine the nature, properties and function of the item and this results in the item being reduced in value, we can deduct an amount corresponding to the reduction in value in the purchase price to be refunded. For example, if you try a dust mask, saw with a saw blade, or drill a hole with a drill, the regret does not apply.
The product is sent back to us in the original packaging and within a reasonable time, together with a right of withdrawal form. The easiest way is to return the item in the same box as when you return the rental object. Then there are no costs for you. Fill in the right of withdrawal form and put it in the box. If you choose to send it back by post or other methods, it is your responsibility until the item has reached us. You must provide your own, suitable packaging and contact us before sending.
13 Intellectual property rights
The content and the service are protected by the Copyright Act. Image material stored on the page has been obtained with permission from the rights holders. Videos on YouTube are links to third-party services beyond Mestal as's control.
14 Privacy
Mestal as processes your personal information in a secure data register in order to fulfill its obligations and safeguard its rights in accordance with the lease agreement. The personal data processed are name, address, telephone number, e-mail address and order history. This history will remain stored for accounting and other obligations. All stored information is available on ""My Account"". The tenant has the right to have their personal data removed from the Landlord's systems, which is done by contacting Mestal as in person.
Your payment card will be stored as long as you have an active order. The payment card is stored at our payment intermediary DIBS. They store the information in a safe and secure manner. Saving payment cards makes it even easier when shopping. You can delete payment cards on your page. Mestal as does not store any credit card details itself.
Mestal as uses cookies, like most other online stores. Cookies store data in your browser so that the website can recognize you from page to page and visit to visit. We can then recognize who you are so that, among other things, you can get the right prices and easier login. We also collect usage information to improve the quality of the service.

15 Choice of law
These terms and conditions are subject to and must be interpreted in accordance with Norwegian law. The agreed venue is Oslo District Court.
16 Changes
Mestal as reserves the right to change or replace these terms and conditions at any time. Current terms and conditions are always available at www.mestal.no. If Mestal as considers that the changes in the terms and conditions are significant in relation to the tenant's rights or obligations, the changes will be made available on mestal.no 30 days before they come into force.
By using the service after the changes to the terms have been made available on mestal.no, you agree to be bound by the updated terms. If you do not wish to accept the new terms, you cannot use Mestal as.
Short version caravan:
Renter / driver:
The tenant must be 18 years of age and hold a valid class B driver's license.
Order:
When ordering, the tenant pays the rental amount.
This as confirmation of the order.
Delivery/delivery:
Delivery between 15.00 to 18.00. Submission between 11:00 a.m. to 12:00 p.m.
Other times by arrangement.
In case of late return, the new day's rent will be charged, unless otherwise agreed.
For caravans, the toilet and waste tank must be emptied.
Fines:
Parking fines, or other impositions a caravan may receive, are covered by the tenant, and a fee of 250 per imposition + the amount of the fee is added.
Damage:
Damage to the caravan, which is caused by the tenant during the rental period, is charged according to the cost of repair.
Pets:
We do not allow pets in our caravans, unless otherwise agreed.
Tenant's responsibility:
The vehicle undergoes a check before rental.
During the rental period, the tenant is responsible for the caravan.
We expect careful treatment of the caravan, so that the trip will be successful.
The caravans are non-smoking.
If unforeseen problems arise, the tenant is obliged to contact Mestal AS to try to solve the problem. Compensation for any reduced use of the caravan is not given for faults and defects which are only reported when returning.
Breakdown:
The landlord does not provide compensation for lost holiday/earnings if damage occurs to the caravan. The deposit and rent paid will then be returned in full. However, we are doing our best to find another caravan.
If a fault / damage occurs during the journey, the hirer will be reimbursed the rent for the days the caravan is for repair, but not for a delay in repair which is less than 12 hours. If the tenant chooses not to spend time on repairs, no refund will be given.
If the error is demonstrably caused by the tenant, no refund will be given.
Most insurance companies offer free travel home for long-term repairs.
We always recommend having your own travel insurance in addition to ours. Preferably NAF insurance which is superb.
Insurance:
Caravans and trailers, the main vehicle and driver's insurance comes with it.
This means that if it is involved in a traffic accident, it follows the car's settlement.
However, we have insurance on trailers, which covers some things. A little difference depending on which caravan it is.
In any case, we recommend that all our customers have travel insurance and preferably NAF insurance, both for travel and otherwise.
It is an added security.
Rental price:
The rent is paid at the time of booking. The rental price is based on free km.
Deposit:
The deposit is NOK 4,000 and will be a reserved account.
Caravans must be delivered clean and tidy. The toilet and waste tank must be emptied.
Cleaning / emptying will be invoiced / a deposit of 2000 kroner will be deducted.
Cancellation:
In the event of cancellation of caravan hire, a fee of NOK 4,000 is payable, which is deducted from the deposit paid.
If cancellation occurs less than 30 days before departure, the fee is 50% of the agreed rent.
In case of cancellation less than 5 days before departure, the rent must be paid in full.
Loss of a key results in a deduction of 2,000 from the deposit
Short version Rental car
Renter / driver:
The tenant must be 18 years of age and hold a valid class B driver's license.
Order:
Upon booking, the entire rental amount is due for payment.
Delivery/delivery:
Delivery between 15.00 to 18.00. Submission between 11:00 a.m. to 12:00 p.m.
Other times by arrangement.
In case of late return, the new day's rent will be charged, unless otherwise agreed. The car must be well cleaned inside and out. The car must be returned with a full fuel tank.
If "no show", the rental is considered completed.
Fines:
Parking fines, illegal toll crossings, illegal use of duty-free diesel, etc. which the lessee has not settled, the lessee will be charged afterwards. In addition, there is a handling fee of NOK 250 per offence.
Damage:
Damage to the vehicle, which is caused by the lessee during the rental relationship, is charged according to the cost of repair. Dents and minor damage that reduce the car's value are charged according to the rate. If insurance must be used to cover the damage, the excess is charged at up to NOK 4,000 per damage. The deposit is used for partial payment of the deductible.
When renting a car, all damages are covered by insurance. Excluding gross negligence, except lost key, which is NOK 2,000, and excluding incorrect fuel, which is the workshop's rate of emptying the tank and engine.
Pets:
We do not allow pets in our cars, unless otherwise agreed.

Tol chip:
Our cars have an autopass tag. The chips are used in all toll rings associated with autopasses, as well as ferries. Fees for passes will be invoiced.
May take 1 month.
Insurance:
The rental price for cars includes full insurance, without excess.
Insurance does not apply in the event of gross negligence.
It is recommended that the tenant take out their own travel insurance. In the event of incorrect fuel filling, use of red diesel or other damage for which the hirer is responsible, and which is not covered by the comprehensive insurance, all expenses must be covered by the hirer.
If the key is lost, NOK 2,000 must be paid.
The cars are linked to Insurance.
NB! In the event of damage, a damage report must be completed.
Rental price:

The car must be delivered clean inside and out (meaning free of rubbish). NOK 2,000 will be charged in the event of non-cleaning.
Cancellation:
In case of car cancellation, there is no refund.

OPERATION/USE
Every driver confirms that he/she is fit to drive a vehicle in Spain, or Norway.
Every driver confirms that he/she is fit to check simple things on the car such as lights, oil level, air pressure, wipers, as well as change7top up if necessary.
(it would be silly if we were to spend 5-6 hours on something you fix in 10 minutes)
Costs will of course be refunded upon receipt.
The renter undertakes to hold the owner harmless, indemnify and release the owner for any damage, personal injury, loss of property or death caused while the renter is operating this vehicle.
It is not allowed to smoke in the car. We have allergy sufferers who rent a car.
If we find ashes or traces of smoking in the car, you will be charged 2,000 for cleaning the car
As these are used cars, things can happen. The lessor must accidentally attempt to deliver a car in the same car class.
If a car is not available as a replacement car, the lessor can offer the full rental amount as a discount on the next rental.
Or, if the tenant wishes, return the car and get the remaining rent refunded.
If the car breaks down or is not in a safe condition as a result of incidents occurring between booking and collection, the lessor is only responsible for a sum up to and limited to the rental sum.
OG shall without delay refund the rent paid, in the same way as the rent was paid.
The lessor is liable up to a limited amount for amounts equivalent to the rent.
